1.1 These Terms of Service ("Terms") constitute a legally binding electronic agreement between you ("User," "you," or "your") and Manas360 Mental Wellness Pvt. Ltd., a company incorporated under the Companies Act, 2013 (CIN U86900KA2026PTC215013), having its registered office at Bengaluru, Karnataka, India, operating the MyAyushClinic vertical ("MyAyushClinic," "we," "us," or "our").
1.2 By accessing, browsing, registering on or otherwise using the MyAyushClinic platform, including the website (www.myayushclinic.com), any mobile or progressive web application, WhatsApp channel, or associated services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms, the Privacy Policy, and all applicable laws.
1.3 If you do not agree to these Terms, you must not access or use the Platform.
1.4 MyAyushClinic may revise these Terms to reflect changes in law, regulatory requirements, or business operations. Revisions become effective upon publication on the Platform. Continued use after publication constitutes deemed acceptance.
2.1 You must be at least 18 years of age to use the Platform independently. Users between 13 and 18 may use the Platform solely upon verifiable consent from a parent or lawful guardian (see Document D2).
2.2 By using the Platform, you represent that you have the legal capacity to enter into a binding agreement under the Indian Contract Act, 1872.
2.3 You agree to furnish true, accurate, current, and complete information at registration and to keep it updated.
3.1 MyAyushClinic is a technology-enabled AYUSH telemedicine marketplace that provides:
3.2 MyAyushClinic operates solely as a technology platform and marketplace enabling Users to access independent AYUSH practitioners ("Practitioners"). MyAyushClinic does not itself provide medical advice, diagnosis, or treatment.
3.3 Any professional engagement initiated through the Platform is a direct, independent relationship between the User and the Practitioner. MyAyushClinic does not control, supervise, or interfere with the clinical judgment, advice, or services of any Practitioner.
AI AYUSH Doc scope. The AI assistant provides general information grounded in classical and contemporary AYUSH sources. It does not diagnose, prescribe, or replace a qualified practitioner. Every AI interaction carries a non-dismissible disclaimer and, on any indication of emergency, directs the User to call 112 and exits the informational flow.
4.1 You are solely responsible for the confidentiality and security of your login credentials and OTPs, and shall promptly notify MyAyushClinic of any unauthorised access or breach.
4.2 You shall not share your account, create multiple accounts, or use another person's account.
4.3 MyAyushClinic may suspend or terminate access for violation of these Terms or for security, compliance, or operational reasons.
5.1 Consultation fees are set independently by Practitioners and displayed before booking. MyAyushClinic does not mandate Practitioner pricing.
5.2 NRI or odd-hour IST servicing may carry a stated premium (flagged at checkout). All fees are in Indian Rupees and inclusive of applicable GST unless stated otherwise.
5.3 Payments are processed through PhonePe / Razorpay via UPI, cards, net banking, or wallets. MyAyushClinic does not store complete financial instrument details and is not liable for payment-gateway failures beyond its reasonable control.
6.1 MyAyushClinic is NOT a hospital, clinical establishment, or medical institution. It is a technology intermediary facilitating access to independent AYUSH practitioners.
6.2 The Platform does not provide medical advice, diagnosis, or treatment. Clinical opinions are solely those of the Practitioner.
6.3 MyAyushClinic does not guarantee specific health outcomes. Results vary with individual circumstances and professional assessment.
6.4 In a medical emergency, Users must immediately call 112 (India Emergency Services) or proceed to the nearest hospital. The Platform is not a substitute for emergency medical services.
7.1 All Platform content, software, algorithms, AI models, the Prakriti scoring model, matching-engine logic, text, graphics, logos, and trademarks ("Platform Content") are the exclusive property of MyAyushClinic or its licensors, protected under the Copyright Act, 1957 and other applicable laws.
7.2 Users are granted a limited, revocable, non-exclusive, non-transferable licence to use the Platform for personal, lawful, non-commercial purposes.
7.3 Users shall not copy, reproduce, distribute, modify, or create derivative works from Platform Content without prior written consent.
8.1 Users agree not to: (a) use the Platform for unlawful or fraudulent purposes; (b) impersonate any person or entity; (c) upload harmful or defamatory content; (d) attempt unauthorised access to Platform systems; (e) interfere with Platform operation; (f) share Practitioner contact information to circumvent Platform fees; (g) record consultations without Practitioner consent; (h) transmit viruses or malicious code.
9.1 To the maximum extent permitted by law, MyAyushClinic shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
9.2 MyAyushClinic's aggregate liability shall not exceed the total amount paid by the User to MyAyushClinic in the twelve (12) months preceding the event giving rise to the claim.
9.3 MyAyushClinic shall not be liable for the acts, omissions, negligence, or treatment decisions of independent Practitioners.
10.1 You agree to indemnify and hold harmless MyAyushClinic, its directors, officers, employees, and agents from claims arising from: (a) your violation of these Terms; (b) your misuse of the Platform; (c) your violation of third-party rights; (d) your breach of applicable laws.
11.1 Disputes shall first be resolved through good-faith negotiation for 30 days.
11.2 Failing negotiation, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator, seated at Bengaluru, Karnataka, conducted in English; the award shall be final and binding.
12.1 These Terms are governed by the laws of India.
12.2 Subject to the arbitration clause, the courts of Bengaluru, Karnataka shall have exclusive jurisdiction.
13.1 If any provision is held invalid, it shall be severed to the minimum extent necessary and the remainder shall continue in effect.
14.1 These Terms, with the Privacy Policy and referenced policies, constitute the entire agreement and supersede prior understandings.
